This agreement is between Pretty Princess, LLC, doing business as Pretty Princess Beauty Bus (hereinafter "Company"), and the undersigned customer (hereinafter "Participant"), or the legal guardian (hereinafter "Guardian"). This agreement governs the terms of participation in activities including, but not limited to: mini manicures and pedicures, facial sheets, makeup application, hair dressing, and paint-and-sip parties. These activities shall be collectively referred to as the "Activities", and their associated risks are described below.
This document shall be effective as of the date it is signed by both parties.
Assumption of Risk
Participant voluntarily chooses to participate in child-friendly spa day Activities provided by the Company. While we strive to minimize risks to our customers, there is a possibility of exposure to potential skin and lung irritants and allergens. Risks include, but are not limited to, exposure to:
Various paint mediums
Aerosols used in nail polish and hair products
Other potential allergens and contaminants found in paint supplies, facial sheets, and makeup
By signing this agreement and engaging in the Activities, the Participant and/or Guardian hereby assumes all risks inherent in such participation and confirms that the Participant is not physically compromised or limited in any way that would impact their ability to safely participate in the Activities provided by the Company.
The Company is not responsible for any injury or damage that may occur.
Release of Likeness
Participant understands and acknowledges that the Company, or others, may take and use photographs, film, audio recordings, or other images of their participation in Activities provided by the Company.
Participant hereby waives, in perpetuity, any rights to privacy, publicity, compensation, intellectual property, or any other rights to any images, videos, or recordings. The Participant further consents that the Company may use or edit such images, videos, or recordings in any way, for any purpose.
Other Provisions, Rules, and Protocols
Communicable Disease
Participant acknowledges the contagious nature of communicable diseases, including Coronavirus (COVID-19). The Company cannot guarantee that the Participant or any other party will not become infected with COVID-19 or any other communicable disease. Participation in Activities may increase the likelihood of exposure and infection.
By signing this agreement, the Participant/Guardian confirms that:
The Participant is not experiencing any symptoms of illness
They do not believe they have been exposed to someone with a suspected and/or confirmed case of any illness, including COVID-19
They are not currently awaiting test results to determine whether they are a carrier of any communicable disease
Personal Property
Participant is responsible for the safety and security of their personal property. The Company is not responsible for any damage, loss, theft, or other misfortune related to the Participant’s belongings.
In consideration for participation in Pretty Princess, LLC Activities, and for other good and valuable consideration, the Participant hereby confirms their understanding of the above terms and further agrees to waive their rights to sue the Company for any cause, including personal injury caused by the negligence of the Company, its owners, employees, or agents.
